Behind the Scenes
The European Commission is halfway through a 14-month investigation into imports of 1,4 BDO from China, Saudi Arabia, and the USA. While the process may seem slow, critical decisions have already been made that expose EU importers to financial risk.
Key points:
- Imports into the EU have been registered since 5 August 2025.
- Provisional duties are likely to be adopted by the beginning of February 2026 (possibly sooner). If so registered imports from the end of October 2025 could be made subject to an additional payment of anti-dumping duties.
- Definitive measures are expected by August 2026.
- When definitive measures are adopted, the regulation will confirm whether the anti-dumping duties will apply retroactively, on imports going back up to 90 days prior to the date of implementation of the Provisional Duties.
Until then, uncertainty remains. Importers may need to provide a financial guarantee to cover the duties imposed on importing 1,4 BDO from China, Saudi Arabia, and the USA.
What Could Duties be imposed?
Duty rates will vary based on producer cooperation:
- Non-cooperating producers: Residual rates of 50–120%.
- Cooperating producers: Specific rates as low as 10%, but possibly up to 30–40%.
The Provisional Measures Regulation will offer the first real insight into financial exposure.
